Your rights to access documents

The Freedom of Information Act 1991 gives you the right to access documents held by City of Prospect and can be used to amend documents that relate to you which are incomplete, incorrect, out of date or misleading.

Information Statement

Many Council documents are publicly available including (but not limited to) policies, codes, assessment records and registers. Most are available on this website and available for inspection at Council’s Customer Service at no charge. Where hardcopy documents are requested, a photocopying fee is required as documented in Council’s Fees and Charges Register.

Requests to access other Council documents that are not publicly accessible can be made under the Freedom of Information Act 1991. Please note, some documents are identified as exempt and may not be available under the Freedom of Information Act.

Freedom of Information (FOI) applications should be submitted using the correct application form and be as specific as possible to enable the correct documents to be identified.

An application fee (in accordance with Council's Schedule of Fees & Charges) must accompany the application. Applications under this legislation will be dealt with as soon as practicable (and in any case, within 30 days) after receipt.
